Royal Canadian Legion Ontario Command
Request received from The Royal Canadian Legion Ontario Command for the Municipality of Central Elgin to advertise in the 6th Military Service Recognition Book.

Background: - This is a unique publication that is exclusively for the Province of Ontario, that recognizes past and present day Veterans in print form with full biographies and photographs. Proceeds raised from this annual appeal are also used to support Veterans Transition Programs to help modern day Veterans that suffer from PTSD and other challenges. The Municipality of Central Elgin has in the past supported this publication.

A Motion was Carried to advertise in the 6th Military Service Recognition Book at a cost of $570.00.

CEP 11-19 - Application for a Consent No. E15/19 - Kyle Derrig, Carly, Lisa and Frank Contardo, 6362 Quaker Road

Background: Consent application E15/19 has been filed for the purpose of a lot addition. The applicants are proposing to convey approximately 1,558.9 m2 of land to the abutting vacant rural-residential lot to the south, municipally known as 6342 Quaker Road.

A Motion moved by Deputy Mayor Marks and seconded by Councillor Row that CEP 11-19 - Consent Application No. E15/19 - Kyle Derrig, Carly, Lisa and Frank Contardo, 6362 Quaker Road be received as information; And that Council support consent application E15/19 to the Land Division Committee, with the following conditions:

  • confirmation from the Municipality of Central Elgin that the existing single detached dwelling located on the retained lot conforms to the Zoning By-law, or confirmation of a successful Minor Variance that recognizes any existing deficiency;
  • confirmation from the Municipality of Central Elgin that the non conforming accessory buildings located on the severed lot have been resolved;
  • the severed land be merged with the abutting lands to the south, municipally known as 6342 Quaker Road;
  • that Subsection 3 or 5 of Section 50 of the Planning Act, R.S.O., 1990, as amended shall apply to any subsequent conveyance or transaction involving the subject lands;
  • the Solicitor for the applicant is to provide an undertaking, whereby he/she informs the Committee in writing, that the lands are being conveyed to an abutting property owner and thus a merger of title will take place, which merger shall include all interests held inclusive or mortgagees interest;
  • and the Municipality of Central Elgin be provided with a copy of the Reference Plan.

CEP 12-19 - Application to Amend Township of Yarmouth By-law 1998 - Dan and Miriam Richard, 45990 Sparta Line

Background: - The applicants have advised staff that they were looking to construct a workshop and secondary residence on their property in order to permit their parents to move in with them. Due to the addition of the proposed use and the constraints on the property based on the location of the existing septic system, the natural hazard and Catfish Creek Conservation Authority’s regulation limits, and the setback requirement from a County Road, a zoning by-law amendment is required to permit the proposed use on the subject lands.

A Motion moved by Councillor Row and seconded by Councillor Fehr that Report CEP 12-19 - Application to Amend Township of Yarmouth By-law 1998 - Dan and Miriam Richard, 45990 Sparta Line be received; And that direction be given by Council to prepare a site-specific draft amendment to the Zoning By-law to permit a 9.14 metre (30 feet) x 13.71 metre (45 feet) accessory building for a work shop and secondary residential unit to be located 6 metres (19.68 feet) from the front property line on lands which may be legally described as Concession 4 South of Part Lot 20 North Side of County Road 27, geographic Township of Yarmouth, now Municipality of Central Elgin; And further that a date for a public meeting be scheduled for Monday, March 25, 2019 at 7:20 p.m. in accordance with Ontario Regulation 545/06 as amended.

CEP 13-19 - Application for a Draft Plan of Subdivision Approval - 1991321 Ontario Ltd. (Domus Developments (London) Inc.)

Background: The applicant approached the Municipality with a proposal to develop lands in the eastern portion of the Community of Port Stanley. The proposal was for a draft plan of subdivision to create lots for single detached dwellings, blocks for single detached dwellings in condominium ownership and a block for a medium density residential apartment.

A Motion moved by Deputy Mayor Marks and seconded by Councillor Cook that CEP 13-19 - Application for a Draft Plan of Subdivision Approval - 1991321 Ontario Ltd. (Domus Developments (London) Inc.) be received;

And that Council support, in principle, the proposed Draft Plan of Subdivision, File No. 34T-CE1901, on lands owned by 1991321 Ontario Ltd. (Domus Developments (London) Inc.), which lands may be legally described as Lots 61 and 62 and part of Lot 63, Registered Plan 11M-31, and part of Lots 1,2,3 and 4 and part of Amelia Street, Registered Plan 24, Former Village of Port Stanley, now the Municipality of Central Elgin;

And that the CAO-Clerk be directed to prepare draft comments on behalf of the Municipality respecting technical, financial, and administrative matters relative to Draft Plan of Subdivision 34T-CE1901;

And further that a date for a public meeting be scheduled for Tuesday, March 26, 2019 at 7:30 p.m. at the Port Stanley Arena in accordance with Ontario Regulation 545/06 as amended.

CEP 14-19 - Application to Amend Village of Port Stanley By-law 1507 - 1991321 Ontario Ltd. (Domus Developments (London) Inc.)

Background: The applicant approached the Municipality with a proposal to develop lands in the eastern portion of the Community of Port Stanley. The proposal was for a draft plan of subdivision to create lots for single detached dwellings, blocks for single detached dwellings in condominium ownership and a block for a medium density residential apartment.

Proposal - The zoning by-law amendment is proposing to change the existing Open Space 2 Zones to a Residential 1 Zone to permit 49 single detached and 19 semi-detached residential lots, a Residential 2 Zone to permit for townhouse condominium development on Blocks 69 and 70 of Draft Plan of Subdivision 34T-CE10901 and an Open Space Zone on Block 74 for natural heritage purposes.

A Motion moved by Councillor Fehr and seconded by Councillor Row that Report CEP 14-19 be received;

And that the Central Elgin Planning Office be directed to prepare draft comments on behalf of the Municipality respecting the zoning by-law amendment for Lots 1-68, Blocks 69 & 70, and Block 74 in Draft Plan of Subdivision 34T-CE1901;

And further that a date for a public meeting be scheduled for Tuesday, March 26, 2019 at 7:30 p.m. at the Port Stanley Arena in accordance with Ontario Regulation 545/06 as amended.

CEP 15-19 - Application to Amend Village of Port Stanley By-law 1507 - 1991321 Ontario Ltd. (Domus Developments (London) Inc.)

Background: The applicant approached the Municipality with a proposal to develop lands in the eastern portion of the Community of Port Stanley. The zoning by-law amendment is proposing to change the existing Open Space 2 Zones to a Residential 2 Zone on Block 71 for high density residential to permit a mid-rise apartment, and a special Residential 2 Zone to permit a mid-rise apartment but would also include provisions for long-term care facility retirement home on Block 72 in Draft Plan of Subdivision 34T—CE1090.

A Motion moved by Deputy Mayor Marks and seconded by Councillor Fehr that Report CEP 15-19 be received as information;

And that the Central Elgin Planning Office be directed to prepare draft comments on behalf of the Municipality respecting the zoning by-law amendment for Block 71 & 72 in Draft Plan of Subdivision 34T—CE1901;

And further that a date for a public meeting be scheduled for Tuesday, March 26, 2019 at 7:30 p.m. at the Port Stanley Arena in accordance with Ontario Regulation 545/06 as amended.

CEP 16-19 - Application to Amend Village of Port Stanley By-law 1507 - Adam and Valerie Dukelow, 382A Edith Cavell Blvd.

Background: The applicants are proposing to rezone the subject lands in order to permit the construction of a single storey residential use to replace the existing single storey cottage. Specifically, the applicant is looking to construct a new residential dwelling with 1.2 metre (4 feet) front yard and side yard setbacks. The lands are currently zoned Open Space 3 (083) zone and Dynamic Beach Standard (DBS) zone which is facilitating the need for a zoning by-law amendment application.

A Motion moved by Councillor Cook and seconded by Deputy Mayor Marks that Report CEP 16-19 be received as information;

And that direction be given by Council to prepare a site-specific draft amendment to the Zoning By-law in support of the proposed residential use on lands located at 382A Edith Cavell Boulevard, which may be legally described as Plan 117, Part Lot 25, South Side Front Street, geographic Village of Port Stanley, now Municipality of Central Elgin.

And further that a date for a public meeting be be scheduled for Monday, March 25, 2019 at 7:10 p.m. in accordance with Ontario Regulation 545/06 as amended.

A Motion moved by Deputy Mayor Marks and seconded by Councillor Cook that Council approve the appointment of Carol Gates, Ted Halwa, Mike Karda, Kim Saunders and Melissa Van Ymeren to the Port Stanley BIA Board of Management; And further that Said appointments be until the expiration of the term of Council in December 2022 as per Report CAO 12-19.

PW 05-19 - 2018 Annual Water Reports for the Belmont Water System and the Central Elgin Distribution System

A Motion by Councillor Cook and Seconded by Councillor Fehr that the Council of the Municipality of Central Elgin receives and approves the Summary Reports and the Annual Reports for both the Belmont Water System and the Central Elgin Distribution System for the year of 2018 as per Report PW 05-19. The Motion was Carried.

PW 06-19 - Municipality of Central Elgin Water Distribution System (St. Thomas Suburban Area) - DWQMS Operational Plan

A Motion by Deputy Mayor Marks and Seconded by Councillor Cook that Report PW 06-19 - Municipality of Central Elgin Water Distribution System (St. Thomas Suburban Area) - DWQMS Operational Plan be received as information.

And that Council of the Municipality of Central Elgin approve and endorse the Drinking Water Quality Management System Operational Plan, Revision 2.0 dated January 1, 2019 for the Municipality of Central Elgin Water Distribution System (St. Thomas Suburban Area);

And further that Council direct staff to execute the Drinking Water Quality Management System Policy with the City of St. Thomas.
