Committee of Adjustment Applications

1. 7:00 p.m. - COA 03-17 - 47278 Dexter Line
CEP 06-17 Application for a Minor Variance No. 3_17 - Tim and Nancy Banick, Concession 1, East Part of Lot 24, 47278 Dexter Line

Background: The applicants are requesting the Committee of Adjustment consider a minor variance application to permit a maximum of 4 horses on the subject lands, which has a lot area of 15.1 acres. The Zoning By-Law requires a minimum lot area of 25 acres for farm use, which includes the keeping of livestock.

Requested Variance: To permit 4 horses on the subject lands, which has a lot area of 15.1 acres, whereas Subsection 2.52 of the Township of Yarmouth Zoning By-Law No. 1998; requires that a farm for the purposes of agriculture shall have minimum lot area of 25 acres.

The Committee voted unanimously to grant this Minor Variance to permit a maximum of four horses on the subject lands, subject to the following conditions: A horse barn and manure storage area shall be setback a minimum of 122 feet (37meters) from the easterly side lot line. The proponent has agreed to transport the waste for proper handling and disposal through an agreement on local area farms.

2.7:10 p.m. - COA-02-17 - 43546 John Wise Line
CEP 04-17 Application for a Minor Variance No. 2_17 - Rick Lee, Concession 6, Part Lot 9, 43546 John Wise Line

Background: The applicant is proposing to construct an addition on the westerly side of the existing building (Lee Memorials), as shown on the plans accompanying the subject application. A minor variance is required, as the addition will increase the total lot coverage for the site to 20%, whereas the 051-90 zone permits a maximum lot coverage of 15%.

Requested Variance:
(i)To permit a lot coverage of 20%, whereas Subsection 8.2.2.90.6 of the Township of Yarmouth Zoning By-law No. 1998 permits a maximum lot coverage of 15%.

Aside from the lot coverage the proposed addition will comply with all other applicable regulations of the Zoning By-law. No Impacts are anticipated as a result of the approval of the subject application, In staff's opinion the proposed variance may be considered minor in nature. The Committee voted unanimously to grant this Minor Variance.

3. 7:20 p.m. - COA 01-17 - 484 Valley Street
CEP 03-17 Application for a Minor Variance No. 01_17 - Tom Bender, 484 Valley Street

Background: The applicants are proposing to construct a new 10 feet x 26 feet sunroom addition and upper deck on the westerly side of the existing residential dwelling. A minor variance is required to construct the addition 15 feet from the front lot line, whereas the Zoning By-law requires a front yard depth of 25 feet.

Requested Variance:
(i) To permit the construction of a sunroom addition and upper deck 15 feet from the front lot line, whereas Subsection 9.2.1.7.1 of the Village of Port Stanley Zoning By-law No.1507 requires a front yard depth of 25 feet.

No adverse impacts are anticipated as a result of the approval of the subject application, in staffs opinion the proposed variance may be considered minor in nature. Lloyd Perrin asked the owners of the property if they would convey a 3 meter by 3 meter triangular section of the corner of the property to the Municipality because of the tight quarters in the area having the road right next to the property line. The owner agreed, and this became a condition of the Minor Variance with the Municipality picking up all legal and survey costs. The Committee voted unanimously to grant this Minor Variance.
