Central Elgin Planning Applications for Monday, February 25th, 2019

Applications

1. 6:40 p.m. - COA 8-19, Sabo, 9818 Tower Road

Background: The applicants are proposing to construct a 20 feet x 26 feet attached garage on the south side of the existing residential dwelling.

Requested Variance(s):

  • (i) To permit the construction of a garage 4 feet-3 inches from the southerly side lot line, whereas Subsection 8.2.1.7.2 of the Township of Yarmouth Zoning By law No. 1998, as amended requires a side yard setback of 15 feet.
  • (ii) To permit eaves and eaves trough to project up to a maximum of 1 feet in to a required yard in an Open Space Zone, whereas Subsection 7.2.2 of the Township of Yarmouth Zoning By-law No.1998, only permits eaves and eaves trough to project up to a maximum of 2.46 feet (0.75 metres) in to a required yard in a Residential Zone.

Correspondence was received from the Catfish Creek Conservation Authority indicating that they had no objections with this application. No other correspondence was received and no one had any objections with this application.

The Requested Variance was granted.

2. 6:50 p.m. - COA 7-19, O'Brien, 147 Wintermute Court

Background: The applicants recently constructed a 2.89 metres x 2.43 metres storage shed within the easterly side yard of the subject lands that does not conform to the Zoning By-law. The proposed variance is requested to bring the existing shed into conformity with the Zoning By-law.

Requested Variance:

  • (i) To permit an accessory building 0.5 metres from an exterior lot line, whereas Subsection 5.1.2(c) of the Village of Belmont Zoning By-law No. 91-21 requires an accessory building to be setback a minimum of 6 metres from the exterior lot line.

Correspondence was received from the Catfish Creek Conservation Authority indicating that they had no objections with this application. No other correspondence was received and no one had any objections with this application.

The Requested Variance was granted.

3. 7:00 p.m. - COA 6-19, Parrack, 140 Bessie Street

Background: The applicants are proposing to expand the existing legal non- complying residential dwelling through the construction of an addition and a detached garage.

Requested Variance(s):

  • (i) To permit a maximum lot coverage of 39.8% for the main building, whereas Subsection 8.4.1.5(a) of the Village of Port Stanley Zoning By-Law No. 1507, permits a maximum lot coverage of 35% for the main buildings.
  • (ii) To permit a maximum lot coverage of 19.6% for accessory buildings, whereas Subsection 8.4.1.5(b) of the Village of Port Stanley Zoning By-Law No. 1507, permits a maximum lot coverage of 8% for accessory buildings.
  • (iii) To permit an addition a minimum of 3.96 feet from the north side lot line, whereas Subsection 8.4.1.6.2 of the Village of Port Stanley Zoning By-Law No.1507, requires a minimum side yard set back 10 feet.
  • (iv) To permit a detached garage a minimum of 3.96 feet from the south side lot line, whereas Subsection 8.4.1.6.2 of the Village of Port Stanley Zoning By-Law No. 1507 requires a minimum side yard setback 10 feet.
  • (v) To permit an addition a minimum of 3.96 feet from the rear lot line, whereas Subsection 6.4.1.6.3 of the Village of Port Stanley Zoning By-Law No. 1507, requires a minimum rear yard setback equal to the height of the main building.

No correspondence was received and no one had any objections with this application.

The Requested Variance was granted.

4. 7:10 p.m. - COA 5-19, Mansell, 5940 Sunset Drive

Background: The applicant is proposing to construct a swimming pool fence, swimming pool, storage shed and pergola on the subject lands, substantially as shown on the site plan accompanying the subject application.

Requested Variance(s):

  • (i) To permit a 1.524 metres high fence in a front yard, whereas Subsection 7.2.1.6 of the Township of Yarmouth Zoning By law No.1998, provides that no fence shall be erected or used in a front yard if the height of any part of the fence exceeds 1 metres.
  • (ii) To permit a swimming pool in a front yard, whereas Subsection 7.2.3.1 of the Township of Yarmouth Zoning By law No. 1998 provides that a swimming pool of any type may be erected, and used in any interior side yard or any rear yard.
  • (iii) To permit an accessory building(s) in a front yard, whereas Subsection 7.2.4.2 of the Township of Yarmouth Zoning By law No. 1998, provides that a utility shed or other accessory building other than a garage, may be erected and used for accessory uses in any yard except a front yard, a required interior side yard, an exterior rear yard and an exterior side yard.

No correspondence was received and no one had any objections with this application.

The Requested Variance was granted.

5. 7:20 p.m. - COA 4-19, Killins, 292 Colborne Street

Background: The applicant is proposing to construct a 3.04 metres x 3.65 metres addition on the front of the existing residential dwelling. The addition will be used to accommodate a new furnace, hot water tank and electrical panel.

Requested Variance(s):

  • (i) To permit an addition 1.97 metres from the front lot line, whereas Subsection 9.2.1.7.1(a) of the Village of Port Stanley Zoning By-law No. 1507 requires a minimum front yard depth of 35 feet (10.668 metres) for lot fronting upon a County Road.
  • (ii) To permit a maximum lot coverage of 28.3% for the dwelling whereas Subsection 9.2.1.6(a) of the Village of Port Stanley Zoning By-law No. 1507 permit a maximum lot coverage of 25% for the dwelling.

No correspondence was received and no one had any objections with this application.

The Requested Variance was granted.
